Shut down doesn't mean much, as long as they aren't actually seized. And even then, unless offsite backup servers (which I'm sure they have a few full sets of backups) are also seized, they can come back up with a new? ISP, in different locations (if necessary), with a new domain name with little harm. The only way to really shut down a site is A) defund it to the point it can't operate, or B) seize enough of it's data that it can't be reasonably brought back up.

@360stev Hard to say. Unlike? thepiratebay (which was taken down last year), megaupload stores actual data, not just links. From what I understand, at least some of their servers are located in the US, so they'll have to move the data out in addition to getting a new domain name that's not a US one. That's assuming they don't wait out the case.

They have to show that megaupload knew the material was infringing when the users were paid since I imagine it's an automated system, that would be hard to prove unless they can show that MU doesn't remove accounts that have a history of posting infringing content. If they can do that then the site should be taken down. But not until *after* the trial. The real injustice here is not the copyright? infringement or the lawsuit, but the early takedown.

Very good point. I think the main point that the FBI is going after is that? they paid their users to upload the content, knowing that it was copyright infringing.

Like youtube, megaupload as a content hoster is protected by safe harbor as long as they take down infringing material when a copyright claim is filed. They do that, thus they cannot be held liable for infringing material that is posted on? their site by users. The lawsuit won't hold up in court (just as the ones against youtube haven't) and the site will be back up. The US gov overstepped by taking the site down before having a trial.
